$900,000.00 Speeding Car Accident

A middle-aged man was riding with his wife and two minor children on a rural road when a defendant failed to yield the right-of-way causing a moderate impact to occur. The defense alleged that the Plaintiff was speeding and caused the crash, and that the Plaintiff suffered from preexisting injuries that caused his damages. This case was complicated due to fact that the Plaintiff was unable to obtain surgical relief for these injuries until approximately one year after the crash.

On the eve of trial, the trial court had ruled that the Plaintiff’s preexisting HIV diagnosis would be admissible at trial which greatly complicated this case. After extensive depositions and on the eve of trial, this car accident settled for $900,000.00, including past medical expenses, lost wages, pain and suffering and loss of enjoyment of life.
