A woman was driving home at 3:00 a.m. when she crashed into a group of motorcycle riders, killing one passenger and leaving a rider in critical condition. Instead of staying on the scene, however, she drove away from the motorcycle accident she caused. Police were able to piece together a description of the car from the other riders and were able to locate it. Finally, the woman turned herself in, telling police she heard a loud noise from the impact, panicked and drove away after seeing the motorcycles sliding across the road behind her.

The hit-and-run driver admitted that she was driving on a revoked license, did not have car insurance and was suspected to be driving under the influence of alcohol.

HIT-AND-RUN DRIVERS MUST BE HELD RESPONSIBLE FOR THE CAR ACCIDENTS THEY CAUSE

Abandoning the scene of an accident isn’t just morally wrong, it is illegal in Tennessee. Under Tennessee law, any driver involved in a car accident where someone is injured or killed must provide their full name and address to the authorities. Additionally, that driver is legally required to ensure everyone who is injured gets the assistance they need.

If you are injured in a hit-and-run accident and the driver is identified, you can file a personal injury lawsuit against the driver responsible under the following circumstances:

  • Your injuries were a direct result of the hit-and-run driver’s actions (they caused the car crash)
  • The hit-and-run driver owed a duty of care to you (meaning, they needed to stop, provide their information and make sure you received assistance)
  • The hit-and-run driver breached that duty (by leaving)

Every driver in Tennessee owes a duty of care to all the other drivers, cyclists and pedestrians on the road. That duty requires them to behave in the same manner a reasonable person would. Leaving the scene of an accident, especially when someone is injured, is not reasonable and the drivers that do so should be held accountable.
