Family Files $6 Million Lawsuit After Nashville Construction Accident

According to the Tennessean, the widow of a 37-year-old Bethpage man killed in a construction accident last year has filed a $6 million wrongful death lawsuit against three companies involved in the incident. workers-comp-after-a-construction-accident

The paper reported that the lawsuit places blame on the masonry, waterproofing and engineering companies involved in the accident, in which a wall collapsed. Maria Velasco-SanAugustin and her three minor children filed the lawsuit on March 20 in the Sumner County Circuit Court.

According to the Tennessean, Jose Velasco-SanAugustin and Joel Pineda Muniz, 24, of Nashville, were killed instantly on April 18, 2013, when the east wall of the store under construction on Indian Lake Boulevard fell on them. A third man was also seriously injured in the accident.

Velasco-SanAugustin was reportedly doing excavation work for Thorne’s Excavating Co. of Lebanon when a strong gust of wind blew down the 24-foot tall block wall, which fell on him. Four companies were later cited and penalized due to the mishap.

Three of the companies, N&S Waterproofing of Nashville, Thorne’s Excavating Co. of Lebanon and Solomon Builders of Nashville, were fined for not adequately bracing the wall, failing to properly limit access to the wall while it was under construction, and not properly training employees on the hazards of working near a wall under construction, according to the Tennessean.

The lawsuit reportedly names Tayes Masonry, N&S Waterproofing and Beaver Engineering Inc. of Nashville as defendants. The family is asking for $3 million in compensatory damages and $3 million in punitive damages, as well as a jury trial.
