Tennessee’s Statute of Limitations for Personal Injury
In Tennessee, most personal injury claims must be filed within one year of the accident under Tenn. Code § 28-3-104. Missing this deadline can result in your case being permanently dismissed, with no path to compensation. While limited exceptions may apply in specific circumstances, waiting to find out whether one applies to you is a risk worth avoiding. Speaking with a Nashville injury attorney early helps confirm your deadline, preserve critical evidence, and protect your right to file.
How Tennessee’s Comparative Fault Rule Affects Your Claim
Tennessee follows a modified comparative fault standard, which means you can still recover compensation even if you share some responsibility for the accident, as long as you’re found to be less than 50 percent at fault. Your total damages award is reduced proportionally by your share of fault. For example, a victim found 20 percent at fault on a $100,000 claim would recover $80,000.
Insurance companies regularly raise shared-fault arguments to reduce or deny claims. An experienced injury attorney can investigate how fault is allocated, gather counterevidence, and advocate for the lowest possible fault percentage assigned to you. This rule applies to car accidents, slip and falls, and most other personal injury cases in Tennessee.
What Kinds of Compensation Are Available in Personal Injury Cases?
When you file a personal injury lawsuit after an accident, you may be entitled to several types of damages depending on the specifics of your case.
Types of damages can include:
- Medical bills
- Lost wages
- Future medical bills
- Pain and suffering
- Loss of enjoyment of life
- Punitive damages
In wrongful death and catastrophic injury cases, family members may also seek compensation for loss of guidance or companionship. Our team can help you identify which types of compensation may apply to your case and pursue them strategically.
Should You Accept an Initial Settlement from an Insurance Company?
After an accident, it’s understandable to want to resolve matters quickly. However, accepting an offer without consulting a personal injury lawyer can create long-term financial and medical risks.
How accepting an initial settlement can harm you:
- Inadequate compensation: Insurance companies often make low initial offers that don’t cover all medical costs, lost wages, or other damages.
- Unforeseen future costs: Some injuries worsen over time; early settlements usually prevent you from claiming additional compensation for later medical needs.
- Complex legal process: Without legal help, you’re up against experienced insurance teams alone, which can lead to unfair outcomes or misunderstood agreements.
Before any settlement is accepted, we evaluate the full value of your claim, including future medical costs and long-term impacts. We also handle all communications with insurance companies on your behalf, so you aren’t pressured into accepting less than your case may be worth.

Filing Paperwork: The Beginning of the Personal Injury Claims Process
After your initial consultation, we’ll schedule another meeting to file the necessary paperwork. Our office is located in Brentwood on Maryland Way (off I-65 and Old Hickory Boulevard). There is a giant eagle statue holding an American flag outside our building. Feel free to park in the parking lot, then head up the elevator to the third floor. After exiting, Suite 309 is to the left at the end of the hall. When you arrive, Morgan at the front desk will greet you and escort you to our main conference room. Danielle or Priscilla will join you there shortly, and Attorney Stan Davis may come in to say a quick hello.
Client Intake Form
We handle most of the paperwork for you. First, we review the items you bring and ask any necessary questions. Then, we complete the intake form with details from you and the accident report, covering who, what, when, where, and how.
Standard Letter of Representation
Next, we guide you through signing our Standard Letter of Representation, which notifies your insurance company that we represent you and directs them to communicate with us moving forward. There may be exceptions to this rule, and we’ll review them with you.
If you’re on Medicare, or even if you’re not, we submit a form to their office so they can monitor your health and recovery throughout the process.
Contract of Employment Between the Attorney and Client
Finally, we’ll fill out The Contract of Employment Between the Attorney and Client. This document gives us permission to represent your interests moving forward.
What Does It Cost to Hire Law Office of Stanley A. Davis, LLC? Nothing!
You’ll have no out-of-pocket expenses. If your case is successful, we receive payment out of your settlement or verdict. This includes the attorney fee as well as any advanced expenses (such as court filing fees and record requests). If your case is unsuccessful, we absorb those expenses.
Once we complete and file these documents, we can discuss the next phase of the personal injury settlement timeline. After you leave our office, we’ll submit the Standard Letter of Representation to your insurance company and send out any medical record requests to your healthcare providers.
You’ll also receive a list of “dos and don’ts” about the personal injury claims process. For example, don't mention your case, accident, or injuries on social media.
Recovering Financial Compensation
Remember, if you don’t get paid, then neither do we. If your case is unsuccessful, you owe us nothing, and we absorb any expenses we fronted.
If your case is successful, the insurance company will send our office three things:
- The settlement check
- A release
- An order of dismissal
These three items are commonly referred to as “settlement docs.” Once we receive them, we’ll invite you back to our office. You’ll sign the release and endorse the check. Then, the check must be held in an escrow account until it clears. This process typically takes several business days. This procedure ensures the check clears. We’ve previously experienced bounced checks from insurance companies, so we take this precaution. Once the check clears, the account disburses the payments.

Documents Needed During Your Initial Consultation
During your initial consultation, we’ll listen carefully to your description of the accident and ask follow-up questions based on the information you’ve already provided. We’ll also need additional details to begin working on your case.
Here is a list of what you should bring:
- The accident report from the police: You should receive a police incident report slip from the officer who arrives at the crash site. It contains the case number, the reporting officer, and directions for how to receive your report, along with a phone number and address where you can pick it up.
- Your insurance company declaration page: Call your auto insurance agent and say, “I need my insurance company declaration page.” They’ll know exactly what you need.
- Your driver’s license: We’ll make a copy of your license at our office to verify your identity. Healthcare providers may request it, and the other party may request this information during discovery.
- A list of doctors and healthcare facilities that you visited due to the accident: We need the name, phone number, and address of each provider you visited. There’s no need to bring your medical records. We can request them directly from your healthcare providers and also request an itemized billing statement on your behalf.
- Your insurance claim number: If you’ve already filed a claim, please bring your claim number and the name of the person you spoke with when filing. If you haven’t made a claim, we can help you.
- Photographs of the accident: If you took photographs of the accident, we’d like to see them. Smartphone pictures are perfectly acceptable. Just bring what you have.
