In August of 2011, James Sowards, 24, allegedly had several drinks at three bars in downtown Nashville: the Buck Wild Saloon, Wildhorse Saloon and Graham Central Station. According to a Tennessee Highway Patrol report, he drove south on I-65 North and struck a car containing two women and a minor. Police charged him with one count of driving the wrong way on a divided highway, one count of reckless endangerment and three counts of vehicular assault.

More than 90 minutes after the accident, Sowards’ blood alcohol concentration was twice the legal limit. Everyone survived the car accident, but the passengers in the other car now suffer “significant” and permanent damages.

The survivors recently filed a lawsuit that blames the bar owners for serving Sowards the alcohol that played a role in the car accident. The suit accuses the bars of negligence and recklessness by serving a patron who was “visibly intoxicated.” Victims Vanessa Hudson and Veronica Rose are seeking at least $3 million in compensatory and punitive damages.

Bartenders must be extremely careful when they choose whom to serve. There were 32,885 deaths involving drunk driving in 2010.
