The wrongful death of a loved one can be incredibly emotional for a family, causing financial difficulties along with pain and suffering. This is especially true when a fatal accident is completely avoidable.

On August 5, noted physician Dr. Eric Raefsky, of Hermitage, was killed in a car accident near Stewarts Ferry Pike in Wilson County. According to the Tennessean, Clayton Rogers was driving on Stewarts Ferry Pike around 9 p.m. when he ignored a traffic signal at South Mt. Juliet Road and slammed into the driver’s side of a car driven by the doctor.

Raefsky was an oncologist with Tennessee Oncology. The crash reportedly ended with both cars in a ditch on the shoulder of Mt. Juliet Road.

Investigators said that evidence found at the scene of the crash indicated that alcohol and drugs could have been in Rogers’ system at the time of the accident. Toxicology reports on Rogers are pending.

Rogers was charged with felony reckless endangerment and cited for failing to yield to a traffic signal.

HOW DO I FILE A WRONGFUL DEATH LAWSUIT?

Through a wrongful death lawsuit, the recovery of economic damages can include the lost income from the deceased family member, medical expenses and funeral costs.

It is tragic whenever a family loses someone because of another person’s reckless acts. There was an average of 9,480 drunken driving accidents each year in the Volunteer State from 2003 to 2007, according to the Tennessee Department of Public Safety. These accidents were all avoidable.
