Recently, in our blog, we discussed Tennessee litigation laws and how you may be able to file a lawsuit against a municipality or state agency following an injury accident. Remember, if you are injured because the city or state failed to maintain its property, or employed a reckless driver or employee, you may have the ability to file a lawsuit.

We bring this up again because recently a motorcyclist died in an accident off Briley Parkway in Nashville after his vehicle struck a pothole and veered into the side of a car. According to WSMV-TV, the accident occurred on March 8. The station reported that 55-year-old John LaSalle of Ashland City was heading northbound when his motorcycle hit a pothole and veered to the right, sideswiping a Honda Accord.

LaSalle was allegedly ejected from his bike. Another motorcyclist who was traveling behind him said that he attempted to lay down his motorcycle to avoid hitting the other vehicle. According to WSMV, officials with the Tennessee Department of Transportation patched the pothole following the crash.

HAVING A VEHICLE ACCIDENT INVESTIGATED

As this case allegedly shows, the failure of a city or state agency to provide the public with safe conditions can be disastrous. Remember, if you are going to attempt to hold a municipality or state agency liable for your accident or your loved one’s death, you may have to file a notice with the entity prior to litigation. This is why speaking to an attorney may prove to be vital if you would like to seek compensation. A lawyer can help guide you through this process, which can be complex.

Aside from vehicle accidents, litigation involving cities could possibly involve pedestrian accidents, slip and falls, and construction accidents. Make sure that you receive legal guidance following an accident. You could potentially seek damages for your suffering.
