The news recently broke that the devastating wildfires in Eastern Tennessee were the result of human activity. The fires destroyed more than 1,700 homes and businesses, killed 14 people and injured more than 150 at current count.

An investigation by the Tennessee Bureau of Investigation, National Park Service, Bureau of Alcohol, Tobacco, Firearms and Explosives as well as the Sevier County Sheriff’s Office identified two juveniles who set the fire on the Chimney Tops hiking trail. The fire, fueled by drought and massive winds, then spread quickly, enveloping and destroying the town of Gatlinburg in less than 15 minutes. The teens face charges of aggravated arson.

The alleged actions of the two teens have destroyed a community and left long-lasting physical and emotional scars for the survivors. Is there any way the survivors and families of those lost can recover damages for this incident?

DAMAGES IN ARSON-RELATED INJURIES

Arson charges will result in a criminal case against the alleged offender(s) who set the fire. But victims who suffer burn injuries and property damage can seek restitution against the offenders as well as insurance companies.

Through the use of a third-party injury claim, victims can fight back against those who commit arson. Victims can seek damages for medical bills, pain and suffering, lost wages, rehabilitation, emotional distress and more. If you have suffered injuries due to a fire, it is important to speak to an attorney who can investigate to determine who is responsible for your personal injuries.
